The terms and conditions in this document apply to my primary service which is private naturopathic consultation unless alternative terms are explicitly stated.
I offer private naturopathic consultations face to face, via phone or online. I offer these services to complement your primary care – to educate and empower you, to advocate for adjunct support should your health (in my opinion) need it.

I take my role as a complementary health care provider seriously and participate in continuous practising education for example, via independent education providers, on occasion industry sponsored educational events, journal subscriptions and as a graduate mentor. I understand the limitations of naturopathic practice and operate within these boundaries.
Your health is your responsibility. The diagnosis and treatment of any illness should always be made in consultation with a health care practitioner. Information on this site should not be should not be regarded as specific treatment advice.
Important Information
Naturopathic health care has diagnostic limitations and after your interaction with me, I may request that you seek consultation with a medical practitioner or allied health service to ensure best practice.
If you have been diagnosed with a specific condition and/or had investigations performed, bringing copies of those with you to your first appointment is greatly appreciated and enables a thorough, objective case to be taken
Waiver of Liability
While I make all reasonable efforts to ensure that my services meet with the highest standards of best practice, if something does go wrong that is not a direct result of my negligence, misrepresentation or deliberate fault, you agree that, to the fullest extent permitted by law, I will not be liable for any damages whatsoever, including but without limitation to any direct, indirect, special, consequential, punitive or incidental damages, or damages for loss of use, profits, data or other intangibles, damage to goodwill or reputation, or the cost of procurement of substitute goods and services, arising out of or related to the use, inability to use, performance or failures of my website, any products or services purchased through it, or any material posted on it, irrespective of whether such damages were foreseeable or arise in contract, tort, equity, restitution, by statute, at common law or otherwise.

Payment Terms
You agree to pay the consultation price specified on the website at the time of service. For those collecting prescriptions with prior arrangement, payment is required as specified on provided invoice. For those receiving orders via post, postage charges will be paid by you. Amounts are stated in Australian dollars. Consultations are GST- exempt, however, all prescriptions incur GST. Smith & Co accepts Mastercard, Visa, AMEX, bank issued EFTPOS cards. No record of credit card details are kept by Smith & Co Naturopathic Medicine.
Delivery & Shipping
Prescriptions can be sent with prior arrangement via Australia Posts prepaid Parcel Post satchels or Express Post Satchels to ensure tracking. I aim to dispatch all orders within 24 hours, but I cannot be held responsible for courier delays and circumstances out of my control.
Appointment Policies
All consultations are by appointment only. Smith & Co Naturopathic is the private practice of self-employed naturopath, Samantha Smith. This is a busy practice with a wait list and last minute cancellations mean a loss of income and missed opportunities for other patients. In the spirt of mutual respect, please notify me if you cannot make your appointment. Smith & Co Naturopathic has a 48 hour cancellation policy and you will be invoiced for 50% of the consultation fee if you fail to notify without reasonable circumstances. Accepting an appointment is acknowledgement of this cancellation policy.
No refund can be offered for services already provided however, if you wish to forward any complaint about advice offered to you I welcome your correspondence and would work towards finding a satisfactory outcome for both parties. If any product purchased from my clinic and under my advice is in any way damaged or faulty please notify me as soon as possible so I can contact the manufacturer and provide a refund or exchange. Change of mind or objections to the taste of a prescription are not grounds for refund or exchange.
Order fulfilment
I cannot guarantee that I will have all elements of an intended prescription at the time your consultation is provided. You will be notified when it is back in stock and arrangements will be made for its collection. In the event a product is discontinued, efforts to source an equivalent will be made. The posting of out of stock items will be at the clients expense.
Unforeseen circumstances
In the event I am unable to attend our scheduled appointment due to illness or unforeseen circumstances, you will be notified with as much notice as possible and your appointment rescheduled as soon as possible to a date that suits both parties. If consulting online and our connection is unstable, your time will be honoured and the consultation transferred to phone.
I take my obligations under Australian Consumer Law seriously and will do my best to address any issues that arise, however, even if there is a major problem.
My liability is strictly limited to:
• Replacing the goods or providing the services again; or
• If I am unable to do so within a reasonable time, paying the cost of having the relevant goods or services supplied to you again.
Comments Policy & Responsible engagement
I reserve the right to delete any comments on my website or social media accounts which are rude, offensive or which I deem to be unacceptable. In the event you are unhappy with the services provided, I request you contact me first before leaving public negative feedback.
Negotiation
If you have any concerns, issues or complaints arising out of your use of this website, my products or services, or these terms and conditions, you agree to communicate with me with the intention of making a genuine effort to seek mutual resolution, and trying to resolve the dispute through negotiation and discussion
Mediation
If we are unable to resolve a dispute by negotiation and discussion within 14 days, we agree to proceed to mediation with the assistance of an independent accredited mediator, seeking online dispute resolution or mediation by telephone if we are not both in Western Australia, Australia.
The mediator is to be appointed by agreement between us or, failing agreement within twenty-one (21) days of the first notification of the dispute, the person initiating the dispute will seek the appointment of a dispute resolution professional by the Resolution Institute: https://www.resolution.institute/resolving-disputes/get-a-professional. The Resolution Institute Mediation Rules shall apply to the mediation and we agree to share the costs of mediation equally between us.
We agree that neither of us will commence legal action until, in the opinion of the independent mediator, the potential for negotiation and mediation have been exhausted.
Non-disparagement
We both agree that we shall not publicly or privately disparage each other or anyone connected with the other’s business, but rather shall act in good faith to refrain from any conduct or communication which might reasonably be expected to negatively interfere with the business and/or personal interests of each other.
